when people upload their videos, they don't really own it fully when it's on YouTube, they give youtube the right, and also, when you upload your video you have the option to share it with Television Networks, or other people on youtube or other websites, and it's automatically set to yes, people don't usually take the time to click no, so yes, and no it is legal...
